Herbicide lawsuits

Mounting evidence suggests a link between commercial herbicides like Gramoxone and many others.  These widely-used toxic chemicals are primarily used for grass and weed control and have been linked to several health-related issues such as Parkinson's disease.

About commercial herbicides

Commercial herbicides are typically tank-mixed with other herbicides for optimized grass and weed control for soybeans, wheat, corn, cotton, citrus, fruits, vegetables, and other crops.  These herbicides are typically applied to fields using commercial-grade sprayers and crop dusters by farm workers.

Roundup Lawsuit
Popular Weedkiller Linked to Cancer

Multiple studies suggest a connection between the weedkiller Roundup and cancer. Bayer knew of these health risks but never warned the public. Now victims are taking them to court for their negligence. The most common injuries are:

Non-Hodgkin’s Lymphoma

 B or T- Cell Lymphoma

 Chronic Lymphocytic Leukemia

You may be eligible for legal compensation if you used Roundup and developed cancer.  Contact the Guardian Legal Network today through our no-cost contact form and pursue the justice you deserve.

History of Roundup
Two Decades of Work

Roundup was introduced to the world by the company Monsanto in 1974. Today, yard workers and civilians have used the herbicide across the United States. The central focus of Roundup is its active ingredient, glyphosate, an effective herbicide at the center of the lawsuit.

A study conducted in 2001 found people exposed to increased glyphosate levels had higher chances of developing the cancer Non-Hodgkin’s Lymphoma. This conclusion was further enforced by a 2009 study studying the effects of herbicides on people. The World Health Organization’s International Agency for Research on Cancer classified glyphosate as “probably carcinogenic” in 2015.

Despite the evidence and statements, Roundup was still sold and used nationwide. Monsanto was eventually purchased by Bayer in 2018, which now manufactures the weedkiller.

Injuries Associated With Roundup
Years of Research

Researchers have studied glyphosate and why it causes cancers in humans. The Lerner Research Institute in Cleveland, Ohio, found that the herbicide activates an enzyme associated with genetic mutation and multiple myeloma development. The Journal of Toxicology published a study in 2017 finding that glyphosate may cause DNA damage. The University of Washington concluded glyphosate exposure could lead to a 41% increased risk of developing Non-Hodgkin’s Lymphoma.

The cancers associated with the lawsuit and glyphosate exposure are:

  Non-Hodgin’s Lymphoma

  B or T Cell Lymphoma

  Chronic Lymphocytic Leukemia

  Hairy Cell Lymphoma

 Mantle Cell Lymphoma

Victims of glyphosate exposure are now holding Bayer accountable for their negligence. Anyone who used Roundup and was diagnosed with any of the above injuries may qualify for legal compensation.

Frequently Asked Questions

No, this is a multi-district litigation or mass tort lawsuit. Instead of holding a figure accountable for breaking the rule of law found in a class action, mass torts are about an individual or group holding another party accountable for their wrongdoing. In this case, the victims of glyphosate exposure are holding Bayer accountable for their negligence in warning consumers about the health risks Roundup poses.

It is possible. Roundup is a widely used weedkiller by both agricultural workers and civilians. Even if you have been exposed to Roundup and glyphosate, large doses and continued exposure are the named causes of these cancers. Small and limited doses should not cause injury.

Yes, with millions of dollars ruled in favor of the plaintiffs in 2018. Bayer announced in 2020 they will pay up to $10.9 billion to settle roughly 125,000 claims. As of September 2022, 100,000 claims alleging Roundup exposure caused cancer have been settled.

Bayer is releasing a new formula of Roundup in 2023 without glyphosate. This removes the glyphosate exposure and cancer risks associated with the old formulation. However, there may still be people who will unknowingly be using the unhealthy formula and will expose themselves to glyphosate as a result. Victims can still file a claim and may qualify for legal compensation as long as the litigation continues.

This is a Mass Tort, Not a Class Action
What's the difference?

In a mass tort, victims are treated as individuals and the specific merits of each claim are taken into consideration. In a class action, every victim has a similar injury and is treated identically.

The benefit of mass tort litigation is that plaintiffs have more power in settlement negotiations which ultimately lead to significantly greater payouts compared to class actions.

  • Settlements and payouts tend to be significantly higher compared to class action awards
  • Plaintiffs have more power in settlement negotiations
